Interpol-Wanted Fugitive Faces Legal Hurdle in Bid for Freedom
The Wynberg Magistrate’s Court has postponed the bail application of Stanislav Stamenov, a Bulgarian national sought by Interpol, until next Tuesday. Stamenov is currently fighting his extradition to Romania, where a 16-year prison sentence for drug trafficking awaits him. Having lived in South Africa for over a decade, Stamenov is seeking release on bail while the legalities of his extradition are processed. However, the court's decision to extend his time in custody marks a significant win for state prosecutors who argue that the fugitive remains a high flight risk.
A Decade-Long Stay Under Scrutiny by South African Authorities
Evidence presented in court revealed that Stamenov has maintained a life in South Africa since 2011, initially entering the country on a visitor’s visa. Over the years, he integrated into the local community, working as a personal trainer and eventually securing permanent residency in 2019. This veneer of stability was punctured when South African authorities discovered he had been sentenced in absentia in 2009, leading to an Interpol red notice issued in 2018. The discovery of his past has now put his legal status in the country under intense judicial review.
Allegations of Fraudulent Residency and Moral Unfitness
The core of the State’s opposition to bail rests on the claim that Stamenov’s permanent residency was obtained through deception. Prosecutors allege that during his residency application, Stamenov failed to disclose his criminal conviction in Romania—a mandatory requirement for any foreign national seeking to live in South Africa. Consequently, the Department of Home Affairs has deemed him an "unsuitable person" to remain in the country. The State argued that someone who successfully evaded international justice for years by falsifying records cannot be trusted to remain in the jurisdiction if released.
