Judicial Mandate for International Fugitive's Detention
The Wynberg Magistrate’s Court has delivered a significant blow to the defense of Stanislav Stamenov, a Bulgarian national living in Cape Town, by ruling that his recent arrest based on an Interpol Red Notice was legally sound. Stamenov, who has been working as a local personal trainer, will remain in custody following the Tuesday court appearance. The ruling underscores the South African judiciary's commitment to international law enforcement cooperation, particularly in cases involving high-level narcotics offenses and long-term prison sentences issued by foreign jurisdictions.
The Romanian Conviction and Extradition Request
Stamenov’s legal troubles stem from a 2019 conviction in Romania, where he was sentenced in absentia to 16 years in prison for his involvement in large-scale drug trafficking. Following the sentencing, Romanian authorities engaged Interpol to facilitate his capture, leading to the issuance of a Red Notice. This international alert eventually tracked him to South Africa, where he had managed to establish a seemingly routine lifestyle in the Western Cape. The Romanian government has since filed a formal request for his extradition to serve the remainder of his decade-plus sentence.
Defense Challenge to Interpol Red Notice Validity
Stamenov’s legal representative, prominent defense attorney William Booth, brought an application to the court challenging the fundamental legality of the February 27 arrest. Booth argued that an Interpol Red Notice serves as a request for location and provisional arrest rather than a domestically valid arrest warrant. The defense contended that the arrest infringed upon Stamenov's rights, seeking his immediate release based on technical procedural grounds. This argument has been a recurring point of debate in South African courts regarding the immediate enforceability of international notices.
