Premeditated Negligence and Fabricated Registration
The Te Kūiti District Court heard evidence that Samson’s actions went beyond simple negligence, bordering on calculated deception. In July 2025, Samson purchased a "project boat" and trailer via Facebook Marketplace that had not held a warrant of fitness since 2016. Despite clear warnings from the seller regarding the rust and images showing holes in the frame, Samson registered the dilapidated equipment as a "2025 homebuilt New Zealand new" trailer at a VTNZ in Hāwera. This fabricated registration was a deliberate attempt to circumvent safety standards before embarking on a 370km journey from Tauranga to New Plymouth.
The Fatal Impact south of Te Kūiti
On July 11, 2025, as Samson traveled south on SH3, the trailer’s drawbar snapped approximately 30cm behind the tow ball. The trailer and the Haines Hunter fibreglass boat it carried careened into the path of Hana-Wetere, who was traveling north with her three-year-old son. The impact was catastrophic; the boat detached from the trailer and smashed through Hana-Wetere's windscreen. She suffered multiple skull and internal fractures and died at the scene. Her toddler survived the crash but witnessed the death of his mother, a trauma the family described as a "heart-shattering avalanche."
Technical Failure and Safety Violations
A police serious crash unit investigation revealed a litany of mechanical failures. The trailer's frame was "compromised by excessive corrosion" to the point of structural failure. Furthermore, the braking system was entirely non-operational; the right brake caliper was seized and contaminated with grease. While the combined weight of the boat and trailer was nearly 2.4 tonnes, the lack of functioning brakes meant the vehicle could only safely tow 750kg. Judge Philip Crayton noted that Samson, who claimed to be a "fabricator and machinist," would have been fully aware of these lethal defects.
