Kody D. Harless, a 28 year old resident of Tomahawk, was sentenced by United States District Judge Robert C. Chambers to eight years and 10 months in prison. The sentencing, which took place in Huntington, also includes a three year term of supervised release. Harless was targeted after law enforcement officials intercepted a significant transaction involving fentanyl, a substance that has devastated communities across the Southern District of West Virginia and neighboring states.
Tactical Interdiction and the Seizure of Lethal Synthetic Opioids
The case against Harless crystallized during a targeted law enforcement operation on August 15, 2023. According to court documents, Harless met with an associate in Huntington to receive approximately 4.75 grams of fentanyl, having pre arranged the purchase with the specific intent to distribute the substance. Following the transaction, officers conducted a high stakes traffic stop of the vehicle Harless was traveling in, leading to the discovery and seizure of the narcotics. During his guilty plea, Harless admitted that the intercepted fentanyl was intended for further sale, highlighting his active role in maintaining the supply chain for illicit synthetic drugs in the region.
Operation of a Cross Border Narcotics Conspiracy
Beyond the single intercepted transaction, Harless admitted to a broader pattern of criminal behavior involving the transportation of controlled substances across state lines. From July 2023 through November 2023, Harless functioned as a courier and distributor within a conspiracy to move fentanyl and methamphetamine from Huntington into Kentucky. By receiving these substances on a regular basis from suppliers in West Virginia, Harless facilitated the expansion of a drug trafficking organization into rural Kentucky communities. This admission of ongoing conspiracy allowed prosecutors to illustrate the systematic nature of the trafficking ring and the defendant's consistent participation in the illegal economy.
