According to the appellate court's findings, trial judge Thomas B. Ewing neglected to confirm whether potential jurors understood the basic constitutional protections afforded to the accused. Under Illinois Supreme Court Rule 431(b), judges must explicitly ask if a jury pool accepts that a defendant is presumed innocent and is not required to offer evidence.
