The court detailed two separate instances of offending that occurred just weeks apart. On July 3, Shaw was observed naked in the male changing rooms near two boys, aged 10 and 13. While initially appearing to apply moisturizer, he was later discovered by a witness touching himself. On July 27, the behavior escalated when Shaw followed two younger boys, aged 9 and 10, into the showers. A member of the public intervened after witnessing Shaw masturbating while staring at the children. Shaw fled the scene before staff could intercept him but was later identified and questioned by police.
Psychological Impact on Victims and Families
Victim impact statements read in court painted a harrowing picture of the aftermath of Shaw's actions. One mother described how her 10 year old son’s sense of normalcy was shattered, stating that the family now experiences severe anxiety regarding public facilities. Another statement detailed how a once confident child has become "a worried mess," struggling with anger and clinginess. The parents emphasized that Shaw’s actions did not just violate their children’s safety but "stole their innocence," creating a permanent barrier of fear in environments that should be safe for play.
Judicial Findings and Premeditation
Judge Tony Couch described the offending as "substantial" and highlighted evidence of premeditation, particularly regarding the second incident where Shaw actively followed his victims. While Shaw’s defense counsel, James Rapley KC, argued that his client was a regular churchgoer who had sought treatment and was a low risk for reoffending, the judge noted that the harm caused was real and lasting. The court also took issue with the timing of Shaw’s legal response, noting that delayed guilty pleas had extended the period of anxiety for the affected families.
