The Discovery of Synthetic Content
The investigation into Noble’s digital activities began in September 2023 after his former partner discovered the material on two mobile phones left at their residence. Upon reporting the find to the police, a digital forensics unit uncovered a total of 601 images and 29 videos classified as objectionable. Noble admitted to using various applications downloaded from mainstream app stores to digitally manipulate his own image, superimposing the faces of children onto mature adult bodies engaged in sexual acts.
Judicial Interpretation of "Objectionable" Fictional Media
During the sentencing, Judge Tom Gilbert addressed the complex nature of AI-generated content that does not depict real victims. He categorized the material as "objectionable" not because it documented a real crime against a specific child, but because its existence "tended to promote the sexual exploitation of children." This distinction is a critical component of New Zealand's legal framework, asserting that the harm lies in the normalization and promotion of such imagery, regardless of whether the subjects are biologically real or digitally synthesized.
Defense Arguments and Offender Background
Noble’s legal representation sought a significantly lower starting point for sentencing, emphasizing that no actual child abuse occurred during the creation of the imagery. His lawyer further argued against Noble’s inclusion on the child sex offender register, citing the fictional nature of the subjects. The court also considered Noble's extensive 19-page criminal history, though it was noted that none of his prior offenses were related to sexual or objectionable material. Reports suggested the offending was triggered by a "derailed" relationship and occurred while Noble was attempting to reintegrate into society as a gardener.
