Critical Defects and Safety Concerns
The lawsuit is seeking at least $750,000 in damages though repair estimates are in the millions to address a litany of structural and systemic failures. Following a property condition assessment by Epic Forensics & Engineering, several critical defects were identified:
Structural Failures: Spalling concrete and exposed rebar on balcony edges, which posed a risk of falling debris onto the streets below.
Water Intrusion: Active leaks in the building's pool and spa features, along with waterproofing failures in the seawall and fire systems.
Systemic Defects: Ongoing issues with elevators, corrosion of post-tension tendons, and waterproofing failures throughout the 66-story structure.
The association’s attorney, David Haber, emphasized that while minor cracks are common in new high-rises, "spalling concrete" and loose debris represent a failure to meet the high standards promised for a luxury brand.
