Los Angeles Superior Court Judge Maurice Leiter determined on Friday that the lawsuit filed by gaffer Serge Svetnoy contains sufficient merit to proceed. This development ensures that Alec Baldwin, 68, will remain under intense judicial scrutiny despite the recent collapse of the criminal prosecution against him in Santa Fe, New Mexico.

Reckless Disregard and the Burden of Proof

Judge Leiter’s ruling centered on the specific actions Baldwin took on the day Halyna Hutchins was killed and director Joel Souza was injured. In his written decision, the judge noted that a reasonable jury could conclude that Baldwin acted with reckless disregard by pointing a firearm toward individuals with his finger on the trigger. While Baldwin has consistently maintained that he did not pull the trigger and was unaware the weapon contained live ammunition, the civil court is focused on the probability that such actions would cause severe emotional distress to those in the immediate vicinity.

Dismissal of Intentional Assault Claims

While the negligence and emotional distress claims survived the defense's motion for summary judgment, the court did provide a partial victory for the actor. Judge Leiter dismissed Svetnoy’s claim of intentional assault, ruling that the plaintiff failed to demonstrate Baldwin had a specific intent to cause physical harm. The judge noted that Svetnoy, who felt the "gust of air" from the discharging revolver but sustained no physical injuries, had not expressed fear of being harmed prior to the weapon firing, which weakened the legal requirements for an assault charge.
