Vermont Migrant Justice Leader Indicted on Federal Human Smuggling and Identity Fraud Charges

Federal Authorities Execute Arrest in Essex Construction Site
Federal agents apprehended Jose Ignacio De La Cruz, a well known 30 year old advocate for immigrant rights, on Thursday morning as he arrived for work at an Essex construction firm. The arrest followed a federal grand jury indictment returned on February 19, which remained under seal until his initial court appearance. According to Migrant Justice spokesperson Will Lambek, De La Cruz was taken into custody by federal agents before being transported to the U.S. District Court in Burlington for his arraignment.
Multi Year Investigation into Transnational Border Activity
The nine count indictment alleges that between November 2022 and June 2025, De La Cruz participated in a conspiracy to bring noncitizens into the United States illegally and transport them within the country for financial gain. Court records indicate the government utilized digital evidence, including a search of the defendant's cellphone and financial records, to track his movements. Prosecutors allege that in one instance in April 2025, De La Cruz met a coconspirator in New Hampshire and received 2,000 dollars to transport an individual who had recently crossed the border.
Strategic Abuse of Vermont Driver Privilege Cards
Beyond the smuggling allegations, the government claims De La Cruz exploited the Vermont driver's privilege card system, a program Migrant Justice helped create in 2014. The indictment asserts that he fraudulently obtained five cards for individuals living outside the state, including one resident of Georgia, by taking online learner's permit tests on their behalf. De La Cruz allegedly charged approximately 500 dollars per card for these services. This development places a spotlight on the oversight of identification programs intended for noncitizens without lawful status.
