Liberal Justice Ketanji Brown Jackson provided the lone dissenting vote, characterizing the majority’s stance as "unprincipled and unworkable." In her dissent, Jackson emphasized that states have a long-recognized responsibility to regulate the medical profession to ensure public health and safety. She argued that the state should have the authority to restrict therapies deemed "dangerous" or "ineffective" by the broader medical community, even if those treatments primarily involve speech. Colorado is one of more than two dozen states, along with the District of Columbia, that currently have similar bans or restrictions on conversion therapy for individuals under the age of 18. Following the decision, Colorado Governor Jared Polis—the nation's first openly gay man elected as a state governor—reiterated his stance that conversion therapy is a "scam" that causes genuine harm to youth.
