Prosecutor General Ruslan Kravchenko confirmed on Monday that the most substantial portion of this recovery, totaling 217.5 million UAH, was finalized in April. This financial influx is the direct result of a successful litigation strategy targeting suppliers who exploited government procurement processes during the early years of the full-scale invasion.

Unlawful VAT Inclusion in Military Contracts

The core of the legal dispute centered on procurement contracts for fuel and lubricants executed for the Armed Forces of Ukraine between 2022 and 2023. According to Prosecutor General Kravchenko, a leading fuel supplier groundlessly included value-added tax in the pricing of these essential supplies, despite legislative exemptions designed to protect the defense budget. This administrative manipulation resulted in the state overpaying millions for fuel that should have remained available for urgent frontline requirements.

Supreme Court Finalizes Commercial Litigation

The Prosecutor General’s Office initiated a series of lawsuits in commercial courts to represent the interests of the Ministry of Defense. The litigation traversed every level of the Ukrainian judicial system, ultimately reaching the Supreme Court.
