Justice Minister Addresses Parliamentary Inquiries on Healthcare Looting

Justice and Constitutional Development Minister Mmamoloko Kubayi has provided a formal update on the status of the investigation into Hangwani Maumela. Responding to inquiries from the Economic Freedom Fighters, Kubayi explained that the current delay in prosecution is a procedural necessity to ensure the National Prosecuting Authority, or NPA, has a viable case. The minister clarified that while significant information has been gathered, it must undergo a rigorous conversion process into admissible evidence before the Director of Public Prosecutions can finalize a decision. This stage of the investigation, known as Leg 4 of the Tembisa Hospital case, remains active under the guidance of the Specialised Commercial Crime Unit.

Scale of Irregularities Uncovered by Special Investigating Unit

The Special Investigating Unit, or SIU, initially implicated Maumela in late 2025 following an exhaustive review of the hospital's financial records. Investigators analyzed 1,728 procurement bundles valued at approximately R816 million, discovering irregularities in 924 of those files. The probe successfully traced 41 distinct service providers back to Maumela, uncovering a complex web of entities used to facilitate the procurement fraud. Furthermore, the investigation identified three companies awarded contracts worth R13 million that were reportedly linked to Vusimuzi "Cat" Matlala, an individual currently facing separate charges for attempted murder.

Judicial Conflict Over Seized Luxury Assets and Vehicles

A significant legal battle is currently unfolding regarding the high-end assets seized from Maumela’s Sandton residence. The Special Investigating Unit previously identified numerous luxury vehicles as suspected proceeds of crime, leading to preservation orders issued by the Asset Forfeiture Unit. However, the Special Tribunal recently ruled in favor of a car dealership seeking the rescission of these orders for five specific vehicles. While the tribunal ordered the release of the cars, it imposed a condition requiring the dealership to provide alternative security equal to the full value of the assets, a decision that is now being contested in the Johannesburg High Court.
