Escalation of a Family Dispute
The violence erupted on Folkestone Drive following a family gathering. According to court proceedings, the victim became incensed by the way Timu was speaking to his partner—the victim’s daughter. Judge Russell Collins noted that the root of the violence was "disrespect towards women," an issue he stated "really does have to stop." The verbal altercation quickly turned physical when the victim attacked Timu’s vehicle with a wooden flagpole, prompting Timu to arm himself with a baseball bat and, eventually, a knife hidden under his shirt.
The Attack and Neighbor’s Intervention
As Timu attempted to drive away, the victim struck his vehicle with the flagpole once more. Timu stopped, exited the ute, and engaged in a physical struggle on the road. During the fight, Timu produced a knife and stabbed the older man twice in the upper left leg and once in the back. A nearby neighbor, witnessing the stabbing, rushed onto the road, tackled Timu to the ground, and wrested the knife from his grip before throwing it over a fence. The victim was rushed to the hospital with serious injuries, including a punctured lung.

The sentencing of Shane Timu highlights the delicate balance New Zealand courts strike between home detention and imprisonment for violent offenses. Despite Timu’s history of violent convictions in 2016, 2017, 2018, and 2025, Judge Collins opted for home detention, partly due to the time Timu had already spent in custody on remand and on electronically monitored bail. However, the judge issued a "certainty" warning: any future appearance for violence would result in an immediate jail term. This case underscores the judiciary's attempt to use home detention as a final rehabilitative step before a permanent shift to custodial sentencing.
