Judicial Resolution for Accomplice in Cushing Death Case
A Maine man involved in the aftermath of a fatal shooting in Cushing has regained his freedom following a court appearance in Rockland. Mark Gagne, 43, appeared in Knox County court on March 12, 2026, to face sentencing for his role in the July 2024 death of 45 year old Kyle MacDougall. Gagne was accused of attempting to dispose of MacDougall’s body, an act that triggered a complex legal process involving both homicide related charges and subsequent narcotics offenses.
Suspended Sentence and Cooperation Agreements
The presiding judge sentenced Gagne to a three year jail term for hindering apprehension or prosecution, but ordered all but 60 days of that sentence to be suspended. Additionally, Gagne received a concurrent 60 day sentence for the abuse of a corpse. Because Gagne had already served a significant portion of this time while awaiting trial, he was released from custody. A key factor in this leniency was Gagne's commitment to testify against Jason Hewett, the individual identified as the shooter in the Cushing homicide.
Concurrent Sentencing for Rockland Drug Offenses
The Thursday proceedings also addressed a series of drug related crimes Gagne committed in Rockland while out on bail for the Cushing case. The court opted to run these sentences concurrently with his existing charges, effectively consolidating his legal penalties. This judicial decision allowed Gagne to resolve all outstanding criminal matters simultaneously, provided he adheres to the strict conditions of his release and fulfills his obligations as a state witness in ongoing proceedings.
