The Petition to Protect Privacy and Reputation
Attorneys representing the 45 year old singer, Edward Burke Jr. and Michael J. Del Piano, are seeking an emergency stay to prohibit the Sag Harbor Village Police Department from fulfilling requests made under the Freedom of Information Law (FOIL). The legal team contends that the dissemination of the video would subject Timberlake to public ridicule and harassment. According to the court documents, the defense argues that the footage includes sensitive medical and familial information that is unrelated to the oversight of governmental operations.
Legal Arguments Against Public Oversight
The petition specifically highlights concerns regarding the interior of Timberlake’s vehicle and personal conversations recorded during the arrest. The attorneys have requested that the court allow for a private review of the footage to propose redactions if total suppression is not granted. They maintain that the release of such "highly personal" data serves no legitimate public purpose, especially given that the criminal case reached a resolution in late 2024.
Background of the Sag Harbor Incident
The request for the footage follows Timberlake's arrest in the early hours of June 18, 2024, in Sag Harbor, New York. According to the original police report, the singer was observed operating a 2025 BMW when he allegedly ran a stop sign and failed to maintain his lane after leaving the American Hotel. Officers on the scene described Timberlake as having bloodshot, glassy eyes and smelling of alcohol. At the time, Timberlake claimed he had consumed only one martini and was following friends home.
