The Sudden Reversal of Commission Recognition
The Independent National Electoral Commission, led by Chairman Joash Amupitan, has formalised a significant shift in the internal power struggle of the African Democratic Congress. By withdrawing its previous recognition of the interim leadership headed by former Senate President David Mark and former minister Rauf Aregbesola, the electoral body has effectively frozen the administrative capabilities of one of Nigeria’s primary opposition platforms. According to Chidi Odinkalu, this move was justified by the commission as a necessary response to a Court of Appeal order intended to maintain the existing state of affairs, yet the timing on All Fools’ Day has sparked intense skepticism regarding the agency's true neutrality.
A History of Judicial Entanglements in Nigerian Politics
This development follows a long-standing pattern where political disputes in Nigeria are frequently transferred from party secretariats to courtrooms to seek legal legitimacy for internal coups. Since the inauguration of President Bola Ahmed Tinubu in May 2023, the use of vague interim orders and complex litigation has become a staple of the political landscape. The current crisis within the ADC mirrored this script, beginning with an orchestrated leadership vacuum after the former ruling Peoples Democratic Party began to lose its viability as an opposition vehicle, leading high-profile defectors to seek refuge and control within the ADC structure.
Conflict Over the Legitimacy of Party Control
The roots of the current paralysis lie in a mid-2025 agreement where the founder of the ADC, Ralph Nwosu, purportedly handed over the reins to a new interim national executive. However, this transition was immediately challenged by Nafiu Bala Gombe, a former gubernatorial candidate, who claimed the chairmanship for himself while disputing the validity of his own reported resignation. Legal proceedings initiated by Gombe at the Federal High Court sought to block the electoral commission from acknowledging the Mark-led faction, though early judicial interventions by Justice Emeka Nwite initially favored a full hearing of all involved parties rather than immediate ex-parte orders.
