Justice Mojisola Dada of the Special Offences Court in Ikeja opted to suspend the trial indefinitely on Monday, citing a complex dispute over the court's current jurisdiction. The Conflict of Jurisdictional Directives
At the heart of the current impasse is a direct contradiction between the directives of Nigeria’s highest courts. While the Supreme Court had previously ordered in May 2025 that the case be reassigned to Justice Dada for a continuous and expedited trial, a more recent January 2026 judgment from the Court of Appeal in Yola has complicated this mandate. Defense counsel Olalekan Ojo argued that the appellate court not only granted his client bail but also directed that the substantive case be remitted to a fresh court for a new beginning. This legal tug-of-war has effectively paralyzed the Special Offences Court, as Justice Dada must now determine which superior court order takes precedence before the trial can move forward.
The Defense Mandate for a Fresh Start
The defense team has taken a firm stance, insisting that the current court no longer possesses the legal authority to hear the matter. Ojo informed the court that a formal request has already been submitted to the Chief Judge of Lagos State to move the case file to a different judge in alignment with the Court of Appeal’s ruling. According to the defense, the appellate judgment remains the binding legal reality until it is explicitly set aside by a higher authority. By filing a motion on notice based on the January 30 judgment, the defense is attempting to reset the litigation clock, arguing that the procedural history of the case necessitates a neutral venue to ensure a fair trial for the socialite.
