The defense argued that the Economic and Financial Crimes Commission (EFCC) has struggled to produce its remaining witnesses, leading to unnecessary delays in the 20-count trial. Emefiele, who faces charges including procurement fraud and abuse of office, has maintained a plea of not guilty across all counts.

Allegations of Forged Presidential Signatures

A key component of the prosecution's case involves the alleged illegal release of $6.3 billion from the apex bank, purportedly intended for international election observers during the 2023 polls. An investigator with the anti-graft agency testified that approval documents for these funds featured forged signatures of former President Muhammadu Buhari and former Secretary to the Government of the Federation, Boss Mustapha. The witness claimed that forensic analysis had confirmed these signatures were falsified.

Forensic Gaps and Cross-Examination Revelations

The credibility of the investigation faced intense scrutiny during cross-examination when the prosecution witness admitted that forensic verification was never performed on the signature attributed to Emefiele himself. The defense quickly capitalized on this admission, arguing that the investigation was incomplete and lacked the necessary forensic weight to link the former governor directly to the alleged forgery.
