During a press briefing in Makurdi, advocates called on the EU to stop obstructing equity provisions that are essential for a fair and effective global response to future health emergencies. The primary concern lies within the Pathogen Access and Benefit-Sharing (PABS) Annex, which serves as the legal framework for how viral data is shared and how the resulting medical benefits are distributed. Stakeholders argue that without a strong, equitable Annex, the international community risks a repeat of the "vaccine apartheid" that characterized the early stages of the COVID-19 era.
The Risk of Repeat Distribution Failures
Dr. Echey Ijezie, the Country Programme Director for AHF Nigeria, emphasized that the EU’s current stance threatens to undermine the values of solidarity and fairness that the bloc publicly promotes. Ijezie cautioned that a weak PABS Annex is not merely a symbolic failure but a direct threat to lives in the Global South. The AIDS Healthcare Foundation is specifically pushing for mandatory benefit-sharing, legal certainty, and real accountability to be baked into the agreement. By blocking these provisions, critics argue that the EU is prioritizing commercial interests and the exclusivity of the Global North over a unified global health defense that protects all nations simultaneously.
Pathogen Extraction versus Benefit Access
Rommy Mom, President of Lawyers Alert, highlighted a fundamental injustice in the current negotiation deadlock: the unidirectional flow of biological data versus the restricted flow of medical solutions. Mom pointed out that while pathogens are collected from every corner of the world to develop diagnostics and treatments, the resulting licensing and distribution rights are often concentrated within wealthy nations. He argued that if a pandemic "hits everyone" regardless of borders, the legal framework for access must be equally universal.
