A Regulatory Directive Amid Political Hardship
The National Broadcasting Commission has issued a formal warning to broadcast stations across Nigeria, threatening punitive sanctions for what it terms "unethical conduct" by presenters and anchors. The directive, issued as the country approaches the 2027 general election cycle, specifically targets news and political programming that exposes failures in the policies of President Bola Tinubu. This regulatory move comes at a time of significant public dissatisfaction fueled by severe economic hardship and persistent insecurity, prompting accusations that the regulator is acting to shield the administration from accountability.
The Constraints on Editorial Expression
Under the new directive, the NBC has prohibited broadcast presenters from expressing personal opinions, bullying guests, or failing to maintain strict neutrality. The commission has classified these infractions as Class B breaches, which carry severe penalties including heavy fines or the total suspension of operating licenses. However, the commission failed to provide a precise legal definition for "unethical" behavior, leading media practitioners to argue that the term is being used as a broad cover to suppress any reporting that is unfavorable to the political establishment.
Legal Challenges to Regulatory Authority
In response to the directive, the Socio-Economic Rights and Accountability Project (SERAP) and the Nigerian Guild of Editors (NGE) filed a lawsuit (FHC/L/CS/854/2026) against the NBC on April 24, 2026. The legal challenge describes the commission's threats as arbitrary, unconstitutional, and an unlawful attempt at prior censorship. Legal experts have highlighted a 2023 Federal High Court judgment which previously ruled that the NBC does not possess the unilateral authority to impose fines on media houses, rendering the commission's current threats legally suspect.
