The Statutory Failure of the First Assistant Claim

The core of the legal dispute centered on the federal Vacancies Reform Act, a statute designed to prevent the executive branch from bypassing legislative oversight through perpetual interim appointments. According to Judge Lamberth, Lake was ineligible for the role because she did not hold the position of "first assistant" at the time the vacancy originally occurred.
