The Federal High Court in Abuja has ordered that Emmanuel Analike, the Chief Executive Officer of NetNaija Media Enterprises, remain in custody pending a formal ruling on his bail application. During a session presided over by Justice Suleiman Liman on Wednesday, the court directed that Analike be moved to the Kuje Correctional Centre. This legal escalation follows a multi-count charge filed by the Nigerian Copyright Commission, which has been tracking the activities of the popular download platform as part of a broader crackdown on intellectual property theft in Nigeria.
Allegations of Systematic Online Piracy and Copyright Breach
According to the charge sheet presented by the NCC, Analike is accused of the illegal possession, production, and distribution of infringed copyright works through the NetNaija website. The prosecution argued that these activities constitute a direct violation of Section 44 (1) (a) of the Copyright Act, 2022. The materials in question reportedly include a vast library of sound recordings and movies, impacting the revenue streams of both Nollywood stars and international production houses. Despite the gravity of the allegations, Analike entered a plea of not guilty to all charges.
Defense Arguments and the Pending Bail Application
The legal team representing Analike, led by counsel Nnemeka Ejiofor, informed the court that a comprehensive bail application had been filed as early as Monday. The application is supported by a 23-paragraph affidavit and a written address intended to convince the bench of the defendant’s eligibility for temporary release. However, Justice Liman declined to deliver an immediate ruling from the bench, opting instead to adjourn the proceedings until March 9, when a formal decision on the bail request will be finalized.
