Legislative Push for Small Business and Consumer Refunds
In response to the ruling, Democratic lawmakers are introducing legislation aimed at returning tariff revenue to the public. Representatives Steven Horsford and Janelle Bynum have proposed a bill requiring Customs and Border Protection to refund tariffs collected over the past year to small and independent businesses. While the Republican controlled Congress makes the passage of such bills unlikely, the move allows Democrats to frame the tariffs as "stolen money." This tactic is designed to put pressure on vulnerable Republicans who must now defend a policy that a plurality of Americans roughly 45 percent according to recent polling view as damaging to the economy.

Even when Democrats address the illegality of the tariffs, they are framing it through the lens of consumer loss. Senator Elizabeth Warren and other prominent figures have taken to social media to claim the administration "stole" money from citizens to fund an illegal trade agenda. By tying the legal defeat of the Trump administration to the rising costs of housing and groceries, the party aims to break through the "online political bubble" and reach general voters who are historically pessimistic about the economy. This strategy draws on successful off-cycle victories in states like New Jersey and Virginia, where cost of living was a central campaign pillar.
