In a significant check on executive power, the Employment and Labour Relations Court in Bungoma has intervened in the mass dismissal of the county’s leadership. Just days after Governor Kenneth Lusaka sacked his entire Cabinet and the County Secretary, the court issued orders under a certificate of urgency to reinstate the affected officials. This ruling effectively freezes the Governor's reorganization plan until a full hearing can determine the legality of the abrupt terminations.

Constitutional Challenges to Dismissal

The reinstated officials, represented by lawyer Peter Wanyama, argued that their removal was not only abrupt but fundamentally unconstitutional. They contended that the dismissals through a press statement lacked any form of prior notice or written explanation. By citing Articles 10, 41, and 47 of the Constitution, the petitioners argued that the Governor’s actions bypassed peremptory legal requirements for fair administrative action, transparency, and the protection of employee rights in the public service.

Governor Lusaka’s Defense of Service Delivery

Governor Kenneth Lusaka had previously defended the mass sacking as a necessary strategic maneuver. He claimed the decision, purportedly anchored in Section 40(1)(a) of the County Governments Act, was made in good faith to enhance efficiency and service delivery for the residents of Bungoma. The Governor maintained that the reorganization was a proactive step to protect the integrity of county institutions and ensured the public that interim measures would prevent any interruption in essential services.
