Colorado voters will decide this November whether to significantly escalate the criminal penalties for child sex trafficking. The Secretary of State’s office confirmed on Thursday that Initiative #108, titled "Penalties for human trafficking of a minor," met the necessary signature requirements to appear on the general election ballot. If approved, the measure would shift the offense from a class two felony to a class one felony. This change would eliminate the current possibility of parole—which can occur in as little as eight years under existing statutes—and replace it with a mandatory sentence of life in prison without parole.
The Signature Drive
The qualification follows a massive grassroots effort led by the coalition Protect Kids Colorado (PKC). Supporters submitted 169,775 signatures, far exceeding the state requirement of 124,238 valid entries. After conducting a random five percent sample, the Elections Division projected the valid signature count to be greater than 110 percent of the required threshold. Erin Lee, Executive Director of PKC, credited thousands of volunteers, including parents, faith leaders, and students, for securing the measure's place on the ballot. The organization argues that current laws have failed to act as an adequate deterrent amid a perceived rise in trafficking cases involving minors.
Broader Legislative Context
Initiative #108 is one of several conservative leaning measures targeting the November ballot. Protect Kids Colorado is also pursuing initiatives related to gender participation in school sports and restrictions on specific medical procedures for minors. Additionally, other measures already cleared for the ballot include a proposal to increase penalties for fentanyl sale or possession and a constitutional amendment requiring law enforcement to report the immigration status of individuals charged with crimes to federal authorities.
