The Push for "Bespoke" Detention
Following revelations of "fight clubs" and the mistreatment of detainees at Mt Eden Prison, Victoria Casey KC issued a report stating that "detention at Corrections facilities should not occur."
The Recommendation: Casey suggested that INZ utilize a tailored legal framework—including electronic monitoring, residence conditions, and reporting requirements—rather than relying on high-security prisons.
The Obstacle: The Ministry of Business, Innovation and Employment (MBIE) maintains that New Zealand is too small to justify a dedicated immigration detention center. However, Casey argued that the "civil detention" templates used by Corrections for low-security groups or public safety orders could provide a safer, more appropriate model.
