Upholding the "Vialidad" Confiscations
The Federal Criminal Cassation Court led by judges Gustavo Hornos, Mariano Borinsky, and Diego Barroetaveña rejected the defense's appeal against the confiscations originally ordered in 2022. The court found that the seizure of assets is a necessary step to satisfy the civil reparations owed to the state.
Cristina Fernández de Kirchner, 73, has been serving a six-year sentence under house arrest since June 2025. She was found guilty of fraudulent administration for the systematic awarding of public works contracts in Santa Cruz province to Lázaro Báez. The scheme, which spanned her presidency (2007–2015) and that of her late husband Néstor Kirchner (2003–2007), involved inflated prices for projects that were often left incomplete or poorly executed.
Scope of the Seizure: Properties and Family Assets
The ruling moves the enforcement phase forward, specifically targeting:
Santa Cruz Properties: One of the ex-president’s primary residences in the southern province.
